Terms of Service
These terms govern your use of Castfrom (“the Service”), provided by Social Marketing Inc., Bunkyo-ku, Tokyo, Japan (“we”, “us”). By creating an account or connecting a social media account you agree to them.
1. The Service
Castfrom lets you connect social media accounts that you own or are authorised to manage, publish content to them, and view performance metrics for that content. Castfrom works through the official APIs of X, TikTok, Instagram, Threads and YouTube. What each network allows can change, and features may be added, limited or withdrawn as a result.
2. Accounts and eligibility
- You must be at least 18 years old and, if acting for an organisation, authorised to bind it.
- You are responsible for keeping your Castfrom login secure and for everything done through it.
- You may only connect social media accounts that you own or that you have explicit permission to manage.
3. Your content
- You keep all rights to the content you publish through Castfrom. You grant us only the licence needed to store it, show it to you and your workspace, and transmit it to the networks you selected.
- You are responsible for the content you publish, including having the rights to any media and music it contains, and for its compliance with the law and with each network’s rules.
- You review each post and its settings before publishing. Castfrom publishes only what you approved, to the accounts you selected.
4. Acceptable use
You agree not to use Castfrom to:
- publish spam, misleading content, or the same content to many accounts in a way that violates a network’s rules;
- publish content that is unlawful, infringing, harassing or otherwise prohibited by the network it is published to;
- access accounts or data you are not authorised to access, or attempt to circumvent a network’s limits or policies;
- scrape, resell or redistribute data obtained through the Service;
- reverse engineer or interfere with the Service.
5. Platform terms
Your use of each network through Castfrom is also subject to that network’s terms and developer policies, including the YouTube Terms of Service, the TikTok Terms of Service, the Instagram Terms of Use, the Threads Supplemental Terms and the X Terms of Service. If a network suspends or limits Castfrom’s access, the affected features may stop working and we are not liable for that.
6. Privacy
How we handle data is described in the Privacy Policy, which forms part of these terms.
7. Fees
During early access the Service is provided to selected clients and partners under the commercial terms agreed with them separately. Any future public pricing will be published on this site before it applies.
8. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted operation. We may change or discontinue features with reasonable notice. Scheduled posts may fail if a network is unavailable or rejects the content; you should check the result of each post.
9. Termination
You can stop using Castfrom and delete your account at any time. We may suspend or terminate accounts that breach these terms or that put the Service’s platform access at risk. On termination we delete your data as described in the Privacy Policy.
10. Disclaimer and liability
The Service is provided as is. To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss caused by a network’s actions, outages or policy changes. Our total liability for any claim is limited to the fees you paid us for the Service in the 12 months before the claim, or JPY 100,000 if no fees were paid.
11. Governing law
These terms are governed by the laws of Japan. Disputes are subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
12. Changes to these terms
We may update these terms. Material changes will be announced in the application at least 14 days before they take effect. Continued use after that date means you accept the new terms.
